"This manual is not a definitive explanation of all law of war issues. This manual focuses on jus in bello -- law relating to the conduct of hostilities and the protection of war victims. This manual seeks to address the law of war that is applicable to the United States, including treaties to which the United States is a Party, and applicable customary international law. It provides legal rules, principles, and discussion, particularly with respect to DoD practice. Although the views of other States may be referenced in this manual, it is not a purpose of this manual to describe the views of other States, which may differ from views expressed in this manual."--page 1.

Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.

Unofficial United States Guide to the First Additional Protocol to the Geneva Conventions of 12 August 1949 Book PDF/Epub Download

The First Additional Protocol to the Geneva Conventions ("AP I") is central to the modern law of war, widely referred to as international humanitarian law outside the United States. It updates the Geneva Conventions for protection of war victims and combines them with new or updated rules governing hostilities and the use of weapons found in the Hague Regulations Respecting the Laws and Customs of War. Due to its comprehensive nature and adoption by a majority of States, AP I is frequently cited as the source for law of war rules by attorneys and others interested in protecting humanitarian interests. The challenge for United States attorneys, however, is that their country is not a party to AP I and has been a persistent objector to many of its new rules. While the United States signed the First Additional Protocol to the Geneva Conventions in 1977, it determined, after 10 years of analysis, that it would not ratify the protocol. President Reagan called AP I "fundamentally and irreconcilably flawed."1 Yet, as will be detailed throughout this guide, United States officials have declared that aspects of AP I are customary international law. Forty years after signing AP I, and 30 years after rejecting it, the United States has never presented a comprehensive, systematic, official position on the protocol. Officials from the United States Departments of Defense and State have taken positions on particular portions of it. This guide attempts to bring those sources together in one location.

This work contains the complete primary text of the electronically issued U.S. Department of Defense Law of War Manual (2016). The Kindle version with full text and footnotes/endnotes is free with the purchase of the paperback, text only version. Anyone who may be in harm's way can benefit from reading one or more sections of this book; whether you are a warfighter, merchant mariner, journalist or just a civilian anywhere where armed conflict could take place; there is a framework of rights and responsibilities that is addressed in this book. From the High Seas, to sieges, from weapons, to parlay's there are a number of rules of engagement and conduct that need to be considered. Any warfighter who wants to do so within the framework of military honor should be familiar with the principles and responsibilities that this book strives to instill; which are, ultimately, aimed at restoring peace. This well researched treatise addresses all aspects of the agreed principles and rules of armed conflict, as well as cyber operations and the law of Air and Space. This is a law book, but in many places the principles are clearly stated. Rather than reading all the introductory matter or dwelling on the technical parts it maybe easier to scan through those areas until the definite propositions come up. In sum this Manual represents the best exposition and supporting documentation on how to honorably and justly resolve conflict by resort to the force of arms. Specifications: Manual Text: 287k words. Reference Text 427k words. 714k words total; 7,047 footnotes.

The British Carrier Strike Fleet after 1945 Book PDF/Epub Download

“A comprehensive study of the bittersweet post WWII history of British naval aviation . . . will become a standard reference for its subject.”—Firetrench In 1945 the most powerful fleet in the Royal Navy’s history was centered on nine aircraft carriers. This book charts the post-war fortunes of this potent strike force; its decline in the face of diminishing resources, its final fall at the hands of uncomprehending politicians, and its recent resurrection in the form of the Queen Elizabeth class carriers, the largest ships ever built for the Royal Navy. After 1945 “experts” prophesied that nuclear weapons would make conventional forces obsolete, but British carrier-borne aircraft were almost continuously employed in numerous conflicts as far apart as Korea, Egypt, the Persian Gulf, the South Atlantic, East Africa and the Far East, often giving successive British Governments options when no others were available. In the process the Royal Navy invented many of the techniques and devices crucial to modern carrier operations angled decks, steam catapults and deck-landing aids while also pioneering novel forms of warfare like helicopter-borne assault, and tactics for countering such modern plagues as insurgency and terrorism. This book combines narratives of these poorly understood operations with a clear analysis of the strategic and political background, benefiting from the author's personal experience of both carrier flying and the workings of Whitehall. It is an important but largely untold story, of renewed significance as Britain once again embraces carrier aviation. “Makes a timely and welcome appearance . . . will make compelling reading for those with serious concern for our naval affairs.”—St. Andrews in Focus

Conceptual and Contextual Perspectives on the Modern Law of Treaties Book PDF/Epub Download

In recent years there has been a flourishing body of work on the Law of Treaties, crucial for all fields within international law. However, scholarship on modern treaty law falls into two distinct strands which have not previously been effectively synthesized. One concerns the investigation of concepts which are fundamental to or inherent in the law of treaties generally - such as consent, object and purpose, breach of obligation and provisional application - while the other focuses upon the application of treaties and of treaty law in particular substantive (e.g. human rights, international humanitarian law, investment protection, environmental regulation) or institutional contexts (including the Security Council, the World Health Organization, the International Labour Organization and the World Trade Organization). This volume represents the culmination of a series of collaborative explorations by leading experts into the operation, development and effectiveness of the modern law of treaties, as viewed through these contrasting perspectives.

This publication, Field Manual FM 6-27 MCTP 11-10C The Commander's Handbook on the Law of Land Warfare August 2019, provides guidance to Soldiers and Marines on the doctrine and practice related to customary and treaty law applicable to the conduct of warfare on land and to relationships between opposing belligerents, in order to train and prepare for combat operations. Although some of the legal principles set forth herein also apply to warfare at sea and in the air, this publication otherwise concerns itself with the rules peculiar to naval and aerial warfare only to the extent that such rules have some direct bearing on the activities of Soldiers and Marines operating on land.Commanders, staffs, and subordinates must ensure that their decisions and actions comply with applicable U.S., international, and in some cases host-nation laws and regulations. Commanders at all levels will ensure that their Soldiers or Marines operate in accordance with the law of armed conflict (LOAC) and applicable rules of engagement. This is an official publication of the U.S. Army and a referenced publication for the U.S. Marine Corps. The principal audience for this publication is Army and Marine Corps commanders as well as Army and Marine Corps judge advocates. Commanders and staffs of Army and Marine Corps headquarters serving as joint task force or multinational headquarters should also refer to applicable joint or multinational doctrine. Trainers and educators throughout the Army and Marine Corps will also use this publication where appropriate. This publication often describes legal concepts in general terms for non-lawyers rather than exhaustively.
