"This book explores the ways to 'rethink', 'repackage' and 'rescue' world trade law in the post-COVID-19 era. Using the COVID-19 pandemic as an important context, the book makes original and critical contributions to the growing debate over a range of emerging challenges and systemic issues that might change the landscape of world trade law in the years to come. The book asks: do these unprecedented times and challenges call for reengineering the world trading system and a further retreat from trade liberalisation? The authors offer a rigorous and insightful analysis of whether and how the existing trade institutions and/or rules, including their latest developments, may provide room to deal with pandemic-induced trade-related issues, sustainable development goals, future crises and other existential threats to the multilateral trading system. The book reinforces the importance of international cooperation and the pressing need to reinvigorate the world trading system. The pandemic has provided a unique opportunity for governments to rebuild the political will needed for such cooperation. One should never let a serious crisis go to waste."--

Between Market Economy and State Capitalism Book PDF/Epub Download

One major issue facing the world trading system today is how to deal with the challenge of China's state capitalism. Many commentators believe that the existing WTO rules are insufficient and, thus new rules are needed. This book challenges this conventional wisdom. Through meticulous studies and fresh analysis of the commitments in China's WTO accession package, existing rules on state capitalism in WTO agreements and recent attempts to make new rules on these issues at the bilateral, regional and multilateral levels, this book argues that existing WTO rules, especially those on subsidies, coupled with China-specific rules in its accession protocol, do provide feasible tools to counter China's state capitalism. This book also discusses the reasons for the lack of usage of these rules and provides concrete policy suggestions on how the rules may be better utilized, as well as how to conduct constructive negotiations on new rules in the WTO and beyond.

Written by leading experts in the field, this collection offers a critical and comparative analysis of the existing case law on international investment law. The book makes a topical contribution to the existing literature, showing most notably that: (1) international investment law has a longer history than that generally considered and that this history is fundamental to understanding its development; (2) international investment law is crafted today by a large number of actors. These include not only investment arbitrators, but also a variety of international and national courts and tribunals; and (3) the literature and case law in languages other than English and from different legal cultures is essential to grasp the essence of the development of the topic. This book brings together more than 40 experts from different countries and legal traditions and combines conceptual analysis and archival investigation of landmark case law to provide the reader with a fresh and innovative understanding of the breadth of international investment law.

As geopolitical considerations increasingly affect global economic activity, delving into the intricacies of State capitalism has never been more timely.

The European Union and International Investment Law Book PDF/Epub Download

This book explores the interaction between the EU and international investment law, both at the internal level, namely within the EU internal market, and at the external level, i.e. in the context of its relations with third States. The joint treatment of these dimensions reveals that the EU has assumed an ostensibly ambivalent attitude towards international investment law. At the internal level, it has consistently asserted that intra-EU international investment agreements (IIAs) are not compatible with EU law and advocated their termination. At the external level, by contrast, it has eagerly deployed IIAs to develop its post-Lisbon international investment policy. The book finds that beneath this apparent ambivalence towards international investment law ultimately lies the EU's attempt to impose, both internally and externally, its own original model of regulation of cross-border investment. It then argues that the EU adopted this approach with a view to supporting its internal market, enhancing its external influence, and, ultimately, pursuing long-term 'federal aspirations'. Finally, the book identifies the legal and political obstacles that have curtailed the EU's efforts at both the internal and the external level.

Flexible Regional Economic Integration in Africa Book PDF/Epub Download

This book examines the relationship between flexible regional economic integration in the East African Community (EAC), through its application of variable geometry, and the establishment of the African Continental Free Trade Area (AfCFTA) as a continent-wide form of integration. It uses a historical, political, legal and economic analysis of the processes that led to the adoption of flexible regional integration in Africa, with particular regard to the EAC. This takes place in the inescapable context of pan-Africanism, showing how regional integration efforts in Africa are based on pan-Africanist ideals, and how an evolution of these ideals has led to an evolution in the goals of integration. With growing awareness of the weaknesses and impracticality of consensus-based decision-making on a global level, it makes the case for the pursuit of flexibility in multilateral trade, drawing lessons from the experience of the AfCFTA and blocs in other regions. This book is a historical evaluation of regional economic integration efforts in Africa and it follows the path of attempts to integrate the economies on the continent from colonial times to the birth of the AfCFTA. While it is a study in law, it relies heavily on politics, economics and history to weave together a more complete theory of economic integration based on the African experience. Flexible Regional Economic Integration in Africa was awarded the 2020 SIEL–Hart Prize in International Economic Law.

Just Transitions and the Future of Law and Regulation Book PDF/Epub Download

This book provides a comprehensive assessment of how national and international efforts to achieve carbon neutrality have been embraced as necessary to meet the requirements of the Paris Agreement as well as the needs of the planet. The authors explore the increasing tensions between aspirations and entrenched practices as methods to implement carbon neutrality are devised, particularly at the national and sub-national levels. This is perhaps best typified by efforts to shift from “dirty” energy production, such as coal, to greener alternatives, which are often supported in laws and rules but opposed by society. To bridge this void, the concept of just transitions has increasingly come to the forefront of international and national focus yet is often poorly understood. This book examines the ways in which just transitions have been proposed as a legal and regulatory bridge to address issues that result in societal resistance to implementation. It uses past and existing practice studies of just transitions before providing an analysis of how just transitions can be used to not only to assist in the shift to carbon neutrality but also in new shifts such as those caused by the Covid-19 pandemic impacts on economy, environment and society, and to address future global challenges.

Moreover, the book is truly global in outlook, being equally useful for students of international trade law in the UK, Europe, the US, Asia and elsewhere around the world. This updated edition includes in-depth discussions of the most recent developments in international trade jurisprudence, setting out important precedents that help establish the boundaries between global trade rules and domestic national autonomy. Investors International Law Book PDF/Epub Download

This book is the first book-length analysis of investor accountability under general and customary international law, international human rights law, international environmental law, international humanitarian law, as well as international investment law. International investment law is currently facing growing criticisms for its failure to address corruption, abuse, environmental damage, and other forms of investor misconduct. Reform initiatives range from the rejection of international law as a governing regime for investors, to the dramatic overhaul of investment treaties that supposedly enable investor overprotection, to the creation of a multilateral international instrument that would enable the litigation of claims against errant businesses before an international tribunal. Whether these initiatives succeed in disciplining investors remains to be seen. What these initiatives undeniably show however, is that change is warranted to counteract this lopsided investors' international law. Each chapter in the book addresses a different and underexplored dimension of investor accountability, thus offering a novel and consolidated study of international law. The book will be of immense assistance to legal practitioners, academics and policy makers involved in the design, drafting, application and reform of various international instruments addressing investor accountability.

Access to Knowledge in the Age of Intellectual Property Book PDF/Epub Download

A movement emerges to challenge the tightening of intellectual property law around the world. At the end of the twentieth century, intellectual property rights collided with everyday life. Expansive copyright laws and digital rights management technologies sought to shut down new forms of copying and remixing made possible by the Internet. International laws expanding patent rights threatened the lives of millions of people around the world living with HIV/AIDS by limiting their access to cheap generic medicines. For decades, governments have tightened the grip of intellectual property law at the bidding of information industries; but recently, groups have emerged around the world to challenge this wave of enclosure with a new counter-politics of "access to knowledge" or "A2K." They include software programmers who took to the streets to defeat software patents in Europe, AIDS activists who forced multinational pharmaceutical companies to permit copies of their medicines to be sold in poor countries, subsistence farmers defending their rights to food security or access to agricultural biotechnology, and college students who created a new "free culture" movement to defend the digital commons. Access to Knowledge in the Age of Intellectual Property maps this emerging field of activism as a series of historical moments, strategies, and concepts. It gathers some of the most important thinkers and advocates in the field to make the stakes and strategies at play in this new domain visible and the terms of intellectual property law intelligible in their political implications around the world. A Creative Commons edition of this work will be freely available online.

The Financial Crisis Inquiry Report Book PDF/Epub Download

The Financial Crisis Inquiry Report, published by the U.S. Government and the Financial Crisis Inquiry Commission in early 2011, is the official government report on the United States financial collapse and the review of major financial institutions that bankrupted and failed, or would have without help from the government. The commission and the report were implemented after Congress passed an act in 2009 to review and prevent fraudulent activity. The report details, among other things, the periods before, during, and after the crisis, what led up to it, and analyses of subprime mortgage lending, credit expansion and banking policies, the collapse of companies like Fannie Mae and Freddie Mac, and the federal bailouts of Lehman and AIG. It also discusses the aftermath of the fallout and our current state. This report should be of interest to anyone concerned about the financial situation in the U.S. and around the world.THE FINANCIAL CRISIS INQUIRY COMMISSION is an independent, bi-partisan, government-appointed panel of 10 people that was created to "examine the causes, domestic and global, of the current financial and economic crisis in the United States." It was established as part of the Fraud Enforcement and Recovery Act of 2009. The commission consisted of private citizens with expertise in economics and finance, banking, housing, market regulation, and consumer protection. They examined and reported on "the collapse of major financial institutions that failed or would have failed if not for exceptional assistance from the government."News Dissector DANNY SCHECHTER is a journalist, blogger and filmmaker. Smart Governance for Health and Well being the Evidence Book PDF/Epub Download

Governance for health describes the attempts of governments and other actors to steer communities, whole countries or even groups of countries in the pursuit of health as integral to well-being. This study tracks recent governance innovations to address the priority determinants of health and categorizes them into five strategic approaches to smart governance for health. It relates the emergence of joint action by the health and non-health sectors, public and private actors and citizens, all of whom have an increasing role to play in achieving seminal changes in 21st century societies. The chapters presented here were initially commissioned as papers to provide the evidence base for the new European policy framework for health and well-being, Health 2020. Calling for a health-in-all-policies, whole-of-government and whole-of-society approach, Health 2020 uses governance as a lens through which to view all technical areas of health.

Food systems at risk Book PDF/Epub Download

The way food systems have evolved over past decades means that they now face major risks, which in turn threaten the future of food systems themselves. Food systems have seriously contributed to climate change, environmental destruction, overexploitation of natural resources and pollution of air, water and soils. Despite the global average improvement in calorie production and major development of the food and agricultural product markets, huge inequalities in food access and repartition of the added value have emerged, leading to new serious nutritional and social problems. Based on a review of the most recent scientific knowledge, this report emphasizes Low-Income and Lower Middle-Income countries where the population faces greater challenges than elsewhere. Different threats are adding up and there are few options to adapt or mitigate these combinations of risks. This is a call for all those - businesses, policy makers, consumers, funding agencies - who are engaged in food systems transformations to bear in mind their systemic aspects and their multiple outcomes and risks in order to be able to fashion more sustainable and equitable food systems. This report was prepared and coordinated by the Centre de coopération internationale en recherche agronomique pour le développement (CIRAD), and is a joint production with the Food and Agriculture Organization of the United Nations (FAO) and the European Commission’s Directorate-General for International Cooperation and Development (DG DEVCO). The scientific report hereunder takes stock of the current and future risks and challenges as regards to food systems.

Asia and China in the Global Era Book PDF/Epub Download

China's strong economic growth occurring alongside modernization across the great majority of Asian societies has created what many see as a transnational space through and by which not only economic, social and cultural resources, but also threats and crises flow over traditional political boundaries. The first section of the work lays out a clear conceptual framework. It draws on arguments about nation no longer being the only container of society, about trans-disciplinary thinking, and about knowledge being context-bound. It identifies and discusses distinctive features of China and Asia in the global era. These include population, urbanization and climate change; the continuing reach of Orientalist shadows; cultural politics of knowledge. It closes by arguing how global studies adds value to existing accounts. The second, and longer, section applies this framework through a series of original empirical case-studies in three areas: migration/poverty/gender; culture/education; well-being. Both the conceptual framework and case-studies are drawn from research presented at HKBU since 2011 under the auspices of the Global Social Sciences Conference Series and supplemented by additional papers.
