A Collective Theory of Genocidal Intent Book PDF/Epub Download

Tackling one of the most confusing and controversial issues in the field of international criminal law — i.e., the genocidal intent element, this monograph seeks to develop an account of genocidal intent from a collectivist perspective. Drawing upon the two-layered structure of the crime of genocide composed of the ‘conduct level’ and ‘context level’, it detects the genocidal intent element at the ‘context level’. The genocidal intent found in this manner belongs to a collective, which significantly departs from the prior individualistic understandings of the notion of genocidal intent. The author argues that the crime of genocide is not a ‘crime of mens rea’. Collective genocidal intent at the ‘context level’ operates in a way that renders the crime of genocide itself a criminal enterprise. The idea of genocide as a criminal enterprise also suggests that genocide is a leadership crime in respect of which only the high-level actors can be labeled as principals (as opposed to accessories). The book criticizes the dominant individualistic approaches to genocidal intent (in particular: the knowledge-based approach) which have thus far governed the relevant jurisprudential and academic analysis. It further demonstrates that the hidden notion of ‘collective genocide’ silently governs the relevant international jurisprudence. Practitioners and academics in the field of international criminal law and related disciplines will find in this book a new approach to the crime of genocide. The text is the first-ever book-length exposition of a collective account of genocidal intent. Its accessibility is highly enhanced by relevant footnotes.Sangkul Kim is Lecturer at Korea University in Seoul and Research Fellow with the Centre for International Law Research and Policy (CILRAP).He served as Associate Legal Adviser at the Office of the Prosecutor of the International Criminal Court (2004-2008). He earned law degrees from Korea University and Georgetown University Law Center.

Smarter Teacher Leadership Book PDF/Epub Download

This pioneering book shares a fresh vision for school leadership that connects current knowledge from mind, brain, and adult learning research to the process of teacher development and leadership. The authors provide clear steps to enable and inspire teachers to embrace leadership and collaboration opportunities for improving instruction and student outcomes, and increasing professional satisfaction. To demonstrate the broad array of leadership pathways, a flexible “spectrum of teacher leadership” suggests the myriad ways for teachers to contribute to their school and community beyond their classrooms. This spectrum is illustrated with real-life examples of teacher leadership in practice. Smarter Teacher Leadership will guide teachers to bridge what has been discovered about the brain and how metacognitive, cognitive, and affective skills support learning, teaching, and leading to stimulate collaboration with colleagues and advocacy with administrators, parents, and the wider community. “Using neuroplasticity and metacognition as key vehicles, Marcus Conyers and Donna Wilson elevate the concept of teacher leadership to a new level of understanding and significance. Their work has a research-based authority, and a deep sensitivity to teachers as professionals, that is both rare and admirable.” —Frank Crowther, emeritus professor, University of Southern Queensland “Teaching and learning are inherently social activities, but too often school culture and teachers’ training and expectations leave them working in a social vacuum. Conyers and Wilson have produced a clear, practical guide to improving teaching through strategic collaboration—a useful addition to the ambitious teacher’s library!” —Mary Helen Immordino-Yang, associate professor of Education, Psychology and Neuroscience, University of Southern California “Smarter Teacher Leadership is an excellent and really useful book for both aspiring and serving leaders. The power model of leadership is developed and is a welcome shift towards purposeful collaboration among teams of people. In an age of dominance of systems and structures this is a refreshing approach.” —Elaine Wilson, University of Cambridge

Centered Riding 2 Book PDF/Epub Download

Centered Riding is not a style of riding as are dressage, hunter seat, or Western. Rather, it is a way of reeducating a rider’s mind and body to achieve greater balance in order to better communicate with the horse. Founder Sally Swift revolutionized riding by showing that good use of the human body makes a world of difference on horseback. Early in her work, she established what she calls the “Four Basics” — centering, breathing, soft eyes, and building blocks—which, together with grounding, are the main tenets of her method. When a rider learns and maintains these basics, then harmony between horse and human is possible. Sally Swift’s first book, Centered Riding, made its revolutionary appearance in 1985 and continues as one of the best-selling horse books of all time. This second book doesn't replace the first one, it complements it. In the intervening years, Centered Riding continued to evolve, and Sally inevitably developed many new concepts and fresh imagery, all of which are presented here.

Contemporary Perspectives On Constitutional Interpretation Book PDF/Epub Download

Current controversies over abortion, affirmative action, school prayer, hate speech, and other issues have sparked considerable public debate about how the U.S. Constitution should be interpreted. Such controversies, along with the changing composition of an often deeply divided Supreme Court, have led to a resurgence of interest in theories of constitutional interpretation. This anthology, edited by Susan J. Brison and Walter Sinnott-Armstrong, presents some of the most exciting and influential contemporary work in this area. Written by ten of the country's most prominent legal scholars, the selections represent a wide variety of interpretive approaches, reflecting different political orientations from the far right to the far left. These theorists have drawn on a variety of other disciplines, including literature, economics, history, philosophy, and politics, and have in turn influenced these fields. The selections were chosen for their accessibility, originality, variety, and importance. Together they provide an excellent introduction to constitutional interpretation as well as a valuable collection for experienced scholars in the field.

The Warrior Mind Book PDF/Epub Download

When we think of martial arts, we think of self defense, but for the true practitioner it is so much more than that. It is a mindset, a form of mental discipline that enables the warrior to face any challenge with grace and strength. In The Warrior Mind, Jim Pritchard, a disciple of legendary Ninjitsu and Taijitsu masters, reveals how we can adopt this mindset whether or not we practice the physical components of the martial arts. Pritchard describes six mental principles: * Attentive curiosity: slow down, observe calmly * Undulation: move side-to-side to build strength * Clear intent: know when and how to act * Grappling: engage the issue or opponent with confidence * Rolling waves: demonstrate persistence and the will to triumph * Whirlwind: when necessary, unleash an all-out onslaught Using colorful anecdotes, insightful examples, and inspiring stories, Pritchard shows how these six principles will help readers maintain focus and balance -- no matter what obstacles await them.

The Structure of Investment Arbitration Book PDF/Epub Download

Although a State’s treatment of foreign investors has long been regulated by international law, it is only recently that international investment law has emerged as an independent discipline in its own right. In recent decades the practical success of investment arbitration has allowed international investment law to develop both its own cadre of academic and professional specialists and its own legal doctrines. This book analyses the structure of international investment law, as it has developed through the practice of investment arbitration in order to see how a variety of international investment law doctrines should be understood and applied. The book demonstrates how a structural analysis can shed light on several major controversies within investment law and also examines what an "investment" actually is. The book offers an original interpretative approach to the resolution of problems in international investment law, and so is one of the few books within the field to attempt to give investment law a solid theoretical basis. It also focuses on only a select number of problems, rather than attempting to deliver the universal coverage currently popular for investment law books. As a result, those issues that are addressed get a detailed discussion rarely available in competing texts.

AAA Yearbook on Arbitration and the Law 23rd Edition Book PDF/Epub Download

For this work, editors Stephen K. Huber and Ben H. Sheppard, Jr. and the University of Houston Law Center collaborate with the American Arbitration Association (AAA), to revive the tradition of publishing an annual survey of important developments in arbitration and the law. Initially published as the "AAA General Counsel's Annual Report" and later as "ADR & the Law," the annual survey has not been published since 2007. The Yearbook will once again be produced on an annual basis. The AAA Yearbook on Arbitration and the Law provides arbitrators and busy practitioners a practical, relevant and readily accessible resource, organized into two parts: Part One contains digests of important decisions of the United States Supreme Court, the United States Court of Appeals and state supreme courts. This volume includes digests of selected judicial decisions from 2007 through 2009, and is current through October 1, 2010. The book contains 130 case digests, together with citations and descriptive cross-references to more than 400 related decisions. Recognizing the important role of arbitration in the global economy, there is a separate chapter containing digests and cross-references to cases dealing with the unique issues presented in international arbitrations. Part Two consists of articles that address a wide range of timely and important arbitration topics, including a comprehensive report on the extraordinary range of services that the AAA provides and a detailed overview of the international activities of the AAA/ICDR, including a report on the successful implementation of the ICDR's pre-arbitral emergency arbitrator procedure, the first such procedure to be adopted by any arbitral institution as a standard part of its rules. Other articles address some of the hottest topics in domestic and international arbitration, such as a survey on the status of "manifest disregard of the law" as a basis to vacate an arbitral award; arbitral cost allocation decisions and whether guidelines should accompany arbitral discretion; a tenth anniversary reflection on experience under The Revised Uniform Arbitration Act; problems posed by arbitrator disclosure and implications of a duty to investigate; whether a private international arbitration falls within "foreign or international" tribunal under 28 U.S.C. Section 1782; and several timely practice pointers for parties seeking discovery in aid of arbitration. The AAA Yearbook re-establishes itself as the preeminent annual yearbook on Arbitration and Dispute Resolution in the United States. It is a required and necessary reference work for all who wish to stay on top of the latest trends, developments , cases and guidelines – accompanied by expert commentary and analysis – in Arbitration and Dispute Resolution.

Crystal Skulls Book PDF/Epub Download

Crystal skulls invoke a sense of mystery. What was their role in ancient times? Are they important for us in current times? Can they assist us on our spiritual journey? How? Although much has been written about them, many questions still linger. This book addresses many of these lingering questions on practical, subtle-energy, and spiritual levels. This long-awaited sequel to Crystal Skulls: Interacting with a Phenomenon weaves practical information on crystal skulls with meditations to provide a deeper understanding of the role of crystal skulls in expanding the consciousness of individuals and humankind as a whole. Filled with useful guidance for both beginners and those who have worked with crystal skulls for long periods of time, Crystal Skulls: Expand Your Consciousness addresses essential issues: what material crystal skulls should be made from, what size to choose, how to clean them, and what to do with them. The most important part of the book addresses awakening the potential of a crystal skull. Learn about the energies of these awakened crystal skulls and the effects they have on the spiritual development of individuals and the collective consciousness of humanity. This book invites you on a journey of awakening the potential of your crystal skulls -- and consequently awakening yourself. Several meditations are given to support this journey along with descriptions of the known ancient and old crystal skulls, making this book a "must have" for anyone interested in crystal skulls and in the journey of spiritual development.

The Editors and the University of Houston Law Center are honored to collaborate with the American Arbitration Association (AAA) and its international division, the International Centre for Dispute Resolution (ICDR), to continue the tradition of publishing an annual survey of important developments in arbitration and the law. The AAA Yearbook on Arbitration and the Law provides arbitrators and busy practitioners a practical, relevant and readily accessible resource. The 24th Edition is organized into three parts: Part One contains digests of important decisions of the United States Supreme Court, the United States courts of appeals and state supreme courts. This volume includes digests of selected judicial decisions from 2007 through 2010, and is current through October 1, 2011. The book contains 176 case digests, together with citations and descriptive cross-references to more than 690 related decisions. We have arranged the case digests under the stages of the entire arbitration process - from the formation of the arbitration agreement to the challenge or enforcement of the arbitral award. Recognizing the important role of arbitration in the global economy, there is a separate chapter containing digests and cross-references to cases dealing with the unique issues presented in international arbitrations. Part Two, an entirely new feature, contains 100 digests of judicial opinions since January 2000 that discuss AAA arbitration rules. For ease of reference the cases are arranged in alphabetical order and are listed by the types of AAA Rules - Commercial, Construction, Employment and International - and by individual rule under each category. Thus the reader can quickly identify all the judicial decisions that discuss a particular AAA rule. Part Three includes selected articles addressing some of the hottest topics in domestic and international arbitration. The AAA Yearbook is the preeminent annual yearbook on Arbitration and Dispute Resolution in the United States. It is a required and necessary reference work for all who wish to stay on top of the latest trends, developments , cases and guidelines - accompanied by expert commentary and analysis - in Arbitration and Dispute Resolution.

Modernist Fraud Book PDF/Epub Download

Focusing on literature and visual art in the years 1910-1935, Modernist Fraud begins with the omnipresent accusations that modernism was not art at all, but rather an effort to pass off patently absurd works as great art. These assertions, common in the time's journalism, are used to understand the aesthetic and context which spawned them, and to look at what followed in their wake. Fraud discourse ventured into the aesthetic theory of the time, to ideas of artistic sincerity, formalism, and the intentional fallacy. In doing so, it profoundly shaped the modern canon and its justifying principles. Modernist Fraud explores a wide range of materials. It draws on reviews and newspaper accounts of art scandals, such as the 1913 Armory Show, the 1910 and 1912 Postimpressionist shows, and Tender Buttons; to daily syndicated columns; to parodies and doggerel; to actual hoaxes, such as Spectra and Disumbrationism; to the literary criticism of Edith Sitwell; to the trial of Brancusi's Bird in Space; and to the contents of the magazine Blind Man, including a defense of Duchamp's Fountain, a poem by Bill Brown, and the works of, and an interview with, the bafflingly unstable painter Louis Eilshemius. In turning to these materials, the book reevaluates how modernism interacted with the public and describes how a new aesthetic begins: not as a triumphant explosion that initiates irrevocable changes, but as an uncertain muddling and struggle with ideology.
